In the Interim Final Rule published in the Federal Register on November 25, 2008, CBP allowed for the soliciting of comments on certain aspects of the rule. These comments are due on or before June 1, 2009.
These comments are limited to the six flexible data elements, as well as the revised regulatory assessment and final regulatory flexibility analysis this includes for the inclusion of additional cost of complying with the ISF interim final rule, the impact of reporting of the flexibility provided in the rule and the barriers of submitting this information 24 hours prior to laden. When filing your comments, be sure to include cost of data collection, service provider fees, as well as the time and personnel needed to handle and maintain the filing. Your comments should reference the specific portion of the rule, explain the reason for any recommended change, and include data, information, or authorities that support such recommended change.
The Flexible Interpretation can be found in section 149.2(f) of the Interim Final Rule and covers:

2.) Ship To Party
3.) Country of Origin
4.) Commodity Harmonized Tariff Number
The Flexible Timing is found in section 149.2(b) and covers:
5.) Container Stuffing Location
6.) Consolidator or Stuffer
