| On August 6, 2025, President Trump issued an Executive Order to address the ongoing national emergency concerning the Russian Federation’s actions against Ukraine. The President determined that it is necessary and appropriate to impose additional duties because the Government of India is currently directly or indirectly importing Russian Federation oil. “Russian Federation oil” is defined as crude oil or petroleum products extracted, refined, or exported from Russia, while “indirectly importing” includes purchasing Russian oil through intermediaries or third countries where the origin can be reasonably traced to Russia.
As a result, articles of India imported into the customs territory of the United States will be subject to an additional ad valorem duty of 25 percent. This new duty will become effective on August 27, 2025, at 12:01 a.m. eastern daylight time. There is an exception for goods that are loaded onto a vessel and in transit prior to this effective date, provided they are entered for consumption or withdrawn from warehouse for consumption before September 17, 2025, at 12:01 a.m. eastern daylight time. This new 25 percent duty is in addition to any other applicable duties, fees, taxes, and charges, unless imports are already subject to actions under Section 232 of the Trade Expansion Act of 1962. The order also grants authority for future modifications based on new information, recommendations, changed circumstances, or if the Russian Federation or an impacted country takes significant steps to address the national emergency. The Secretary of Commerce is tasked with identifying any other countries that are directly or indirectly importing Russian Federation oil.
